1. Acceptance of these Terms
These Terms of Service govern use of
https://buff0k.co.za and its related pages and invited-user features. The
website is operated by Eben van Deventer under the name BuFf0k from Mpumalanga,
South Africa.
By accessing the website or using an invited-user account, you agree to these Terms. If you do not agree, you must not use the invited-user features.
2. Nature of the website
BuFf0k.co.za is a personal blog and development hub containing how-to guides, technical commentary, project showcases and information relating to open-source projects. It is not a paid, subscription-based or advertising-supported service.
Content is provided for general informational and educational purposes. It is not professional legal, financial, medical, engineering, security or other regulated advice.
3. Eligibility and invited accounts
Invited-user accounts are limited to persons aged 18 years or older who have been invited or otherwise authorised by BuFf0k. There is no public right to registration or continued account access.
Users may authenticate through Google Sign-In.
Users are responsible for securing their Google accounts and for all activity
carried out through their invited accounts. Suspected unauthorised access must
be reported promptly to buff0k@gmail.com.
4. Permitted use
You may browse publicly available content and use invited-user functions for lawful, personal and good-faith purposes. Any use of open-source project code is governed by the licence published with the relevant project or repository.
Unless expressly permitted, you may not use the website in a way that damages, disables, overloads, circumvents or interferes with the website, its security, its users or its infrastructure.
5. Prohibited conduct
You may not:
• Use the website for unlawful, fraudulent, abusive, defamatory, threatening, discriminatory or harmful activity.
• Attempt to gain unauthorised access to accounts, systems, source code, databases, backups or administrative functions.
• Probe, scan, test or exploit security weaknesses without prior written authorisation.
• Introduce malware, automated spam, scraping loads, denial-of-service traffic or other disruptive code or activity.
• Impersonate another person or misrepresent your identity, authority or affiliation.
• Publish content that infringes intellectual property, privacy, confidentiality or other rights.
• Collect or process information about other users without a lawful basis and appropriate permission.
6. Comments and profile descriptions
Invited users may submit comments and profile descriptions. You retain ownership of content you create, but you grant BuFf0k a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format and display that content only as reasonably necessary to operate, present, moderate, back up and maintain the website.
You warrant that you have the right to submit the content and that it does not violate law or the rights of another person. BuFf0k may moderate, edit, hide or remove user content at any time where reasonably considered necessary for legal, security, quality or community reasons.
Account deletion may result in comments being deleted, anonymised or retained without identifying account details where necessary to preserve the continuity of a discussion or record.
7. Intellectual property
Unless a page, project or repository states otherwise, the website design, branding, articles, guides, original images and other original site content are protected by copyright and other applicable intellectual property laws. Copyright is asserted under the BuFf0k name and is held by Eben van Deventer operating as BuFf0k.
Public availability does not place content in the public domain. You may view and make reasonable personal use of site content, but may not reproduce, republish, sell, commercially exploit or create misleading derivative copies without permission.
Open-source software, documentation and project assets are governed by the specific licence stated in the relevant repository or project. Where no licence is stated, no open-source or reuse licence is implied.
8. Third-party services and links
The website uses or may link to third-party services, including Google Sign-In, Google Analytics, Google Drive and external code repositories or websites. Third-party services are governed by their own terms and privacy policies.
BuFf0k is not responsible for the availability, security, accuracy, content or practices of third-party services or websites.
9. Technical guides and development materials
Technical guides, scripts, configuration examples, code and project materials may be incomplete, experimental or unsuitable for a particular environment. You are responsible for reviewing, testing, backing up data and assessing risks before applying any instructions or code.
You must not rely on website content as a substitute for professional review where failure could cause injury, legal exposure, security compromise, service interruption, financial loss or data loss.
10. Availability and changes
The website and any feature may be changed, suspended, restricted or discontinued at any time without creating an obligation to continue providing it. Maintenance, technical failure, security incidents or circumstances outside BuFf0k's control may cause interruption or loss of availability.
These Terms may be updated from time to time. The current version will be published on the website. Continued use after publication of an updated version constitutes acceptance of the updated Terms.
11. Suspension and termination
BuFf0k may suspend, restrict or terminate an invited account where the user breaches these Terms, creates legal or security risk, attempts unauthorised access, disrupts the website, misuses content or services, or where continued access is no longer appropriate.
A user may delete their own account. Account deletion is subject to the deletion and backup provisions described in the Privacy Policy.
12. Disclaimer of warranties
The website, its content and development materials are provided on an as-is and as-available basis. To the fullest extent permitted by law, no warranty is given that content is complete, accurate, current, secure, error-free, fit for a particular purpose or continuously available.
Nothing in these Terms excludes any warranty or right that cannot lawfully be excluded under applicable South African law.
13. Limitation of liability
To the fullest extent permitted by law, BuFf0k and Eben van Deventer will not be liable for indirect, incidental, special or consequential loss, loss of data, loss of profits, business interruption, security compromise or damage arising from reliance on website content, use of development materials, third-party services or inability to access the website.
Where liability cannot lawfully be excluded, liability will be limited to the extent permitted by applicable law and in proportion to the operator's actual responsibility for the proven loss.
14. Privacy
Use of personal information is governed by the BuFf0k Privacy Policy published on buff0k.co.za. By using an invited account, you acknowledge that authentication, account management, security logging, analytics and other necessary processing will occur as described in that policy.
15. Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa. Before commencing formal proceedings, the parties should attempt in good faith to resolve a dispute by written communication.
Any dispute not resolved informally will be subject to the jurisdiction of a competent South African court, subject to any mandatory consumer or other legal jurisdiction that cannot lawfully be excluded.
16. General provisions
If any provision of these Terms is invalid or unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver of that provision. These Terms, together with the Privacy Policy and any project-specific licence, constitute the applicable agreement concerning use of the website.
